{"id":358,"date":"2013-02-12T10:47:07","date_gmt":"2013-02-12T09:47:07","guid":{"rendered":"http:\/\/www.studiolegalericcio.it\/studio-legale-torino\/?p=358"},"modified":"2013-03-14T15:08:48","modified_gmt":"2013-03-14T14:08:48","slug":"animali-domestici-e-condominio","status":"publish","type":"post","link":"https:\/\/www.studiolegalericcio.it\/studio-legale-torino\/animali-domestici-e-condominio\/","title":{"rendered":"ANIMALI DOMESTICI E CONDOMINIO"},"content":{"rendered":"<p><a href=\"http:\/\/www.studiolegalericcio.it\/studio-legale-torino\/avvocato-luigi-riccio\/img_3623\/\" rel=\"attachment wp-att-322\"><img decoding=\"async\" class=\"size-thumbnail wp-image-322\" alt=\"Morgana,  mascotte e valida collabratrice\" src=\"http:\/\/www.studiolegalericcio.it\/studio-legale-torino\/wp-content\/uploads\/2012\/10\/IMG_3623-150x150.jpg\" width=\"150\" height=\"150\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">La recente Legge 11 dicembre 2012 n.220, definita &#8220;Codice del Condominio&#8221;, che\u00a0 ha regolamentato in modo uniforme la materia, ha stabilito, all&#8217;art.\u00a0 16 che:\u00a0 &#8220;<em>Le norme del regolamento non possono porre limiti alle destinazioni d\u2019uso delle unit\u00e0 di propriet\u00e0 esclusiva n\u00e9 vietare di possedere o detenere animali da compagnia&#8221;.\u00a0<!--more--><\/em><\/p>\n<p style=\"text-align: justify;\">Tuttavia la questione non \u00e8 cos\u00ec semplice, in quanto la Commissione Giustizia,\u00a0con propria circolare, ha specificato ulteriormente la portata della\u00a0norma.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #333333;\">E&#8217; bene precisare, infatti, che i condomini possono, con voto assembleare espresso all&#8217;unanimit\u00e0,\u00a0\u00a0formare o modificare il regolamento di condominio, inserendo clausole limitative. Cos\u00ec pure il regolamento che vieta la detenzione di animali \u00e8 vincolante per l&#8217;acquirente di una unit\u00e0 immobiliare facente parte di un condominio, ogni qual volta il regolamento stesso sia trascritto alla Conservatoria dei regisri immobiliari o\u00a0sia riportato\u00a0nell&#8217;atto di acquisto.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #333333;\">In buona sostanza,\u00a0chi ha la fortuna di avere un cane,\u00a0un gatto\u00a0\u00a0o un altro\u00a0\u00a0nostro <em>&#8220;fratello minore<\/em>&#8220;, intendendo acquistare casa, deve ancora stare attento a quanto dispone in punto il\u00a0 reglamento di condominio, perch\u00e8 se quest&#8217;ultimo \u00e8 trascritto va ritenuto\u00a0 vincolante, in quanto accettato; ci\u00f2
